1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern your use of thehomecareagency.com (the “Site”) and the services offered by The Home Care Agency (“The Home Care Agency,” “we,” “us,” or “our”). By using the Site or submitting a form, you agree to these Terms. If you do not agree, please do not use the Site.

2. Nature of the Service

The Home Care Agency provides a free service that helps families check potential program eligibility and arrange in-home care with an independent, licensed home care agency that serves their area — including for Medicaid-funded home care and home care for veterans. We are not a Medicaid provider agency, we do not employ caregivers, we do not provide care, and we do not bill Medicaid. Final eligibility for any program is determined solely by the applicable state agency.

We are not a home care provider, do not employ caregivers, and are not affiliated with, endorsed by, or acting on behalf of the U.S. Department of Veterans Affairs (“VA”) or any other government agency. We are not VA-accredited, we do not determine VA eligibility, and we do not prepare, file, or assist with VA benefit claims.

3. Educational Information Only

Any information we provide about VA programs — for example, Aid & Attendance, Veteran-Directed Care, or the Homemaker / Home Health Aide program — is general educational information only. It is not legal, financial, medical, or benefits advice. Eligibility for any VA program is determined solely by the U.S. Department of Veterans Affairs. For benefits questions, please consult VA.gov or a VA-accredited representative.

4. No Guarantees

We do not guarantee that you will:

  • Qualify for any program or receive any benefit;
  • Receive any particular benefit amount or number of care hours;
  • Receive care from any particular agency; or
  • Achieve any specific outcome.

5. Independent Agencies

The home care agencies that provide your care are independent third parties. The Homecare Agency is not responsible for and does not endorse, supervise, or guarantee the services, acts, omissions, quality, licensing, or conduct of any agency. Any care arrangement is solely between you and the agency.

6. Cost

Our service is free to you. We are compensated by the home care agencies in our network through a flat marketing fee. You never pay us.

7. Consent to Be Contacted & Text-Messaging (SMS) Terms

By submitting a form, you consent to be contacted by The Home Care Agency by phone call, SMS text message, and email, including through automated dialing systems and AI / artificial-voice technology. Consent is not a condition of receiving any service, and you may opt out at any time — reply STOP to any text message, or ask to be removed during any phone call.

(a) Program description

This messaging program is operated by Web Properties Corp, doing business as The Home Care Agency. When you submit a form on the Site with your mobile number and check the consent box (the box is never pre-checked), you may receive text messages from The Home Care Agency about your care request — for example, a confirmation that we received your inquiry, follow-up messages if we cannot reach you by phone, and messages that help us schedule or complete your request. The Home Care Agency is the only sender of text messages under this program; no other party sends you text messages under this program. You must be at least 18 years old and the subscriber or authorized user of the mobile number you provide.

(b) Message frequency & rates

Message frequency varies; you will receive up to 4 messages per month. Message and data rates may apply — these charges are set by your mobile carrier and are your responsibility.

(c) HELP & STOP

For help at any time, reply HELP to any of our text messages or contact us using the details in the “Contact Us” section below. To stop receiving text messages, reply STOP at any time — we will send one confirmation message and then stop texting you. Opting out of text messages does not remove you from phone calls or email; to stop those, ask to be removed during any phone call or contact us directly.

(d) Carriers & delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and is not guaranteed.

(e) Messaging privacy

We do not share, sell, or otherwise provide your mobile phone number, mobile opt-in data, or SMS consent information to any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or transferred to any third party for any purpose. 8. Your Responsibilities

You agree to provide accurate and complete information. If you submit information on behalf of a veteran, you confirm that you are authorized to provide that veteran’s information to us and to the licensed home care agency that will provide the requested care.

9. Intellectual Property

All content on the Site — including text, graphics, logos, and design — is owned by Web Properties Corp (d/b/a The Home Care Agency) or its licensors and is protected by applicable intellectual-property laws. You may not copy, reproduce, or distribute it without our prior written permission.

10. Disclaimers

The Site and our service are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, The Homecare Agency and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or our service, the conduct of any home care agency, or any care arrangement.

12. Indemnification

You agree to indemnify and hold harmless The Homecare Agency and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in New York.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after a change takes effect means you accept the updated Terms.
