Under New York’s Licensed Home Care Services Agency (LHCSA) model, you can choose your own caregiver — your paid caregiver must become a New York State–certified Home Health Aide (HHA) or Personal Care Aide (PCA) employed by the agency, and the agency provides the required training and certification at no cost, so a family member or friend can still become your paid aide. By state rule, your spouse, your parent, your child (son or daughter), or a child-in-law cannot be your paid aide. Aides must be 18+ and legally able to work in the U.S.

Program Guide
Personal Care Services (PCS) is a New York State Medicaid benefit, overseen by the Department of Health, that pays for hands-on help at home — bathing, grooming, toileting, meal preparation, housekeeping. The aides are employed by home care agencies: Licensed Home Care Services Agencies (LHCSAs) that contract with Medicaid plans and local social services districts.
For families, the practical meaning is simple: if your loved one qualifies, Medicaid — not your family — pays for approved in-home care, and a trusted person in your life may be able to become the certified aide who provides it.
The person needing care must have (or qualify for) New York Medicaid — Medicare alone does not qualify. For assessments on or after September 1, 2025, adults seeking personal care generally must be assessed as needing at least limited physical assistance with more than two activities of daily living; for people with a dementia diagnosis, at least supervision with more than one activity of daily living. People already receiving services stay under the prior criteria.
Eligibility is confirmed through an independent community health assessment and a clinical appointment arranged through the New York Independent Assessor Program, repeated at least annually. Financial eligibility is determined by the Medicaid program — not by us, and not by any agency.
After the independent assessment, services are authorized by the local social services district or the Medicaid managed care plan, and an agency is engaged to provide the aide.

New York works differently from self-directed states: your chosen caregiver becomes a New York State-certified Home Health Aide or Personal Care Aide employed by the licensed agency. The agency provides the required training and certification — typically at no cost to the caregiver — then handles payroll, scheduling support, and supervision.
By state rule, payment cannot go to the person's spouse, parent, son, daughter, son-in-law, or daughter-in-law. Other relatives and friends can often serve — a sibling, grandchild, niece, nephew, or neighbor — subject to the program's rules about relatives living in the home. Aides must be at least 18 and legally able to work in the U.S. Eligibility for any aide is determined by the program during enrollment.
